Just found out this month that my ex from 1991, wants to fill a lawsuit against me for back child support from 1999 and 2000. I told her I was on SSDI since 1999. My ex I just found out did not go to the SSA until 2002. She got back pay from 2001, 2002 and got SSDI from 2003 to 2008. The amount of SSDI she got was more than 2 times the original child support ordered in 1993. Now she wants back child support from 1999 and 2000. I paid her $1,400.00 in 1999, and $800.00 in 2000 because I believed she had applied for the SSDI benefit. The so called owed back child support was $7000.00 Now she wants the 9% interest for 12 years, which would mean about $14,000.00 now. Between 2001 and 2008 she received about $27,000.00 more in SSDI benefits than she would have in actual child support ordered. Her attorney claims that none of that overpaid can be used toward the back child support owed. So, first, can she blame me if she chose not to apply for the SSDI in a timely fashion, and can she actually have 65% of my current SSDI garnished from so called child support owed from 1999. When I called child support in 2008 and recently they told me the case was closed and no child support was owed... Please help.
