Hello
My mom has been just visiting in Florida for a month. I've really bored to shop with her so today dropped her off at Sears inside a big mall, on video she's seen by security of sears while walking out of Sears store to a tobacco shop with a big `Smoking Area` sign which is 10 steps away from store's exit(also a resting area 5 steps away from exit with couches). Anyway she walked out 10 steps to smoke until she realized it was actually a tobacco shop, when she understood that she immediately turned back to the sears while holding those 2 items in hand. Then Sear's security came from the store. (She has visited around 85 countries and multiply that with at least 3 malls per country, so I don't blame her for assuming it was actually a smoking area inside the store.)
She doesn't speak english so when she tried to explain herself with hand gestures and 20 word grammar he shouted him `shut up`, the guy kept telling her she's spanish and she has to `shut up` and she told him that she's turkish, this time he told her `no you're arabic` and `you have to shut up` and another shut up for 3 times. Security took her to security room, I don't know why but he put those 2 items inside her purse and took out and done that 3 times to show her maybe she's caught stealing?? But even on cameras her purse has nothing to do about this except taking her cigarette out. This story also proved by Mall's camera but apparently that Security only looked to sears camera so I don't blame him (the act that she walked out to tobacco shop and then turned back to walk in while holding those 2 items)
Anyway my mom is really traumatized because of this incident. First time in her life something happened liked that. She has spent 10 hours in jail with cokeheads . She was still crying when I went to pick her up. Even though even my car that she just bought to me is worth 3 times more of this guy's yearly salary. I'll still want to sue him for not doing his research good, racism and most importantly the abnormal 10 hours he put my mom through.
I understand 1 of 11 Americans do shoplift but she's obviously not American.
I've paid 600$ to bail bonds guy but also I've learned her court date will be after she returned to her country (3rd of june).
What should I do ? Should I sue him ? With that perfect case, is there a chance to take her court date before the day she leaves (26 days from today, probably not) ?
