A roommate of mine moved out 45 days ago with 3 months remaining on our lease. She only pays a portion of her rent, I pay the balance to avoid eviction. I'll go to court for that later... She now wants to come back to the apartment to put a padlock on her door until the lease is up.(just to be difficult). Can she do this? Or has she abandon the lease. She has to go to the lanlord to get a key.

Did she move all her belongings out and return the key? Did she give notice of her intention to vacate? Will she pay the arrears and the balance of the lease?

She moved all her things out and gave me the key but the landlord is aware she moved out.

I don't know if she gave written notice or not. All I know is the landlord is aware she moved. She also knows I'm taking her to court. She's not going to pay restitution

If she relinquished the keys she moved out. She is not entitled to move back in. However, before you can complete the suit you (or the landlord if she was on the lease) have to show you have made a good faith effort to replace her. You can't sue her for future rent.
