View Full Version : Sublet 4-day notice to vacate by alcoholic "friend"

I am subletting a room from basically a lifelong friend which was supposed to be temporary all along. We knew it might only last until June 2012, but she never "informed" of her alcoholism and daily consumption of 5 drinks of alcohol (which is annoying to say the least and has ruined the environment for me), and in addition, she flaked on writing up a rental agreement.

Now I am beginning to see why. Since I've moved in 2+ months ago, its been obvious that she has serious gripes with her landlord and actually plans to sue him for illegal entry (he has walked into the house when she wasn't home twice on her two daughters!), and the entire time I've lived with her the theme has been "her problems became my problems. 1 week ago she told me, "I just wanted to let you know that this might just be your 1 or 2 week notice. We just found and applied for a new house, and I talked to a lawyer and blah blah I can sue the landlord, he recommended we move out by the 11th (of this month - May)." So, two weeks previous I had given her ample (early) notice of my intent to vacate, since I was pretty much miserable living with her. I had committed to 3 months. Blech. Anyway, she then told me that, drink in hand (always drink in hand) I had until June 1st to move out, then the next day I had to move out right away because I kept her up at night (I took a shower and woke her up ONCE)... and her story always changes.

So, basically, the bottom line is now she is moving out in 4 days, and I have no idea what my actual rights are without a written sublet contract other than the typical 30-day notice, especially since she apparently isn't planning on paying this month's rent to the landlord and expects me to be out in 4 days too. That's 8 days notice, NOT 30 days notice, which is what she ORIGINALLY gave me.

WHAT'S MY COME BACK, if need be? IF I can't find a place, what are my rights, as in, do I buddy up with the landlord? I'm done with this "friendship" anyway - she's pushed and pulled me around anyway she's seen fit in her alcoholic blur justifying anything. I'm pissed, and just wondering what my ground to stand on is.

We need to know what state this is.
Also did you pay her for May and do you have proof of all payments.
I take it you haven't had any dealings on a paper or money level at all with the LL?
Tenant law regarding rooms rented from a renter is often not addressed at all. Whoever signed the lease is what matters. You are treated how she is treated. If she moves out in 4 days and you don't, the landlord is obligated to evict her, and if she is charged with additional expense because you failed to move out, she has to sue you.
If a landlord tries to treat you as a trespasser, various other factors apply, such as proof that you have been there X amount of time and that your possessions are there, not just an overnight bag. I take it he knows you are there.
I would talk to him about paying for a week or so past the day she moves out, if you need it. I see no reason to avoid the landlord. (Just keep your problems with her to one sentence so that you sound like a reasonable person.)

Thank you very much. I can't believe I forgot to mention this is in Oregon.
