Aggravated battery

Like a domestic battery, aggravated battery requires that the defendant either cause some type of bodily harm to the victim or make contact that is insulting or provoking to the victim. A domestic battery can become an aggravated battery under the following scenarios:

1. An "aggravating" factor common in domestic situations is that in committing the battery, the defendant used a potentially deadly weapon.

2. An "aggravating" factor seen in domestic cases is that the victim of the battery was pregnant, and the defendant knew the victim to be pregnant.

There is also a charge called Aggravated Domestic Battery. This is when the injury inflicted is one of "great bodily harm." This usually requires more than bruises or red marks - usually it requires stitches or broken bones.

Aggravated battery is a felony, punishable by either time in the Department of Corrections, or a term of probation often times accompanied by time in jail.

You can also receive an extended sentence because of the endangerment to the unborn child.
