View Full Version : Can my lanlord take me to court for unpaid rent

I have a question. I owe my landlord rent money and now he's taking me to court for it. I've asked him numerous of times to fix my apartment but he hasn't. Now being that I don't have a lease and he's still taking me to court is there anyway to fight that, I can pay what I owe installements not the full thing any suggestions.

Why would you think he couldn't? If you live on the premises you have to pay rent. If you don't pay what you owe you can be sued for it.
If there were conditions that made the apartment uninhabitable, you had to deal with them according to law, not just stop paying. One of the things you had to do was pay your rent into a separate account so you could pay your back rent when repairs were made or you were ordered to. Then you wouldn't be in this fix.
So now you have to negotiate with the landlord to pay what you owe or show why you shouldn't be required to pay.

Yes, and in fact you may end up being evicted, ( thrown out) ( told to leave by the court at a certain date and physcially removed if you don't leave)
But yes you owe the money and most likely they will want payment in full. They will get a judgement if you don't pay.

Think about it. You couldn't pay this month's rent in full when due. If the LL were to agree to take what you owe in installments, how could you make the installments and pay next month's rent? Unless you can show LL that you are going to get extra money in the future, LL would be a fool to accept such a proposal.
