Liz - first, what country are you in, and second, it would help to give us a bit more information about the nature of the accident and the type of insurance you have. Finally - I assume by "bold tyre" you mean "bald tyre," right?

Your guess is better than mind I have no idea what bold tyre is, I thought it was something about a aggressive driver ?

But if your tires were so bad as to be the cause of the wreck, and you were not keeping your car in driving condition, yes the insurance company may try to use that to lower or deny your payments

Sorry guys, yes I meant bald tyre. I live in wales uk. I was hit at the rear end of drivers side, it has a huge dent to the side an its has split the metal. Also rear bummper has come loose. I was only doing between 5-10mph as was turning out of a street. He's accepted liability... lack of concentration. The bald tyre is the front passanger side. I'm also fully comp an they've give me a hire car(not at my cost) hope this helps with my question!
