I bought a property on my cousins name in 2006 because my credit history was bad at the time I paid all the fees 10%deposit all legal cost around 40000 pounds was paid now he does not want to leave the property or give it back to me he is messing me around is there anything I can do legally I do have some evidence were the deposit money was paid from and some other miner evidence , I just want my property back can I take him to court can you please help.

Do you have, IN WRITING, any sort of agreement to support this contention and what was agreed ?

You committed a fraud by fooling the lenders into thinking he bought the property. By putting everything in his name you relied on his eventually turning over the property to you.

Unless you can prove that there was an agreement to do so, you, in effect gifted him the property.

Of course you can stop paying the mortgage and see what happens.

Sorry, he owns the property and you appear to have no legal contact with him to pay you or to give you the property,

Also he can not "give it back" since it was never yours to start with, it was always his from when it was purchased.

If you can prove that you "loaned" him the money and he was suppose to pay you the money back, perhaps you can sue for the money that you gave him.

But since what you wanted to do was basically fraud against the bank or lender, you can not profit or inforce a illegal contract.
