View Full Version : Can I ask that tenants move before closing on a short sale property?

I am in contract for purchasing a short sale property in NH which has been approved by the original lender. There is a main house and two studio units that comprise the property. The current tenants did not have leases and expressed desire to stay in their units. Originally, I did not have problem with this, but due to non-cooperation issues with the one of those tenants (not the property owner), I now wish to request that the property be delivered vacant and find my own tenants after I take ownership.

Can I now request that the property be delivered entirely vacant?

Not really, unless you want to blow the whole deal off. It'll probably cost you your earnest money...

Thoses tenants are considered month to month tenants, only the owner can require them to leave. It's a short sale, neither the bank nor the owner is likely will to skip the rent money. You can request what you want but I doubt if anyone will be interested, you are lucky the bank even agreed to the short sale, these can take 6 months to close.
