I received a summons for credit card debt that was charged off but purchased by a collection agent. I have 30 days to respond with my answer since it was left in my door. That gives me until 3/12. My question is I am going to be claiming bankruptcy but I still need to answer this or I was told by the clerk that they can get a judgement and go after my wages and bank account. She also said she couldn't tell me much but that I could hire a lawyer-don't have the money-or write a letter with my answer but that I had to make sure it was done properly or it could be rejected by the judge. Anyone know where I can get a form or how to write an answer? She couldn't tell me anymore.:( It's for NY.

Every individual court has its OWN requirements for how they want their documents submitted. There are no forms to fill out.
Buy a copy of the "Rules of Civil Procedure" for the particular court in which these documents must be filed. You can find it in your local college bookstore. In the rules, you'll find out everything - how big the margins should be, the size of the font, who it's addressed to, etc. It won't tell you what to say, however.
Where you put in the good part, say you deny the claim.

PS> OR, you can just write a letter to the judge. He might accept it or he might not, if he's a prick.

IF you just want to buy time, deny the claim, and request they supply documents showing it is a valid debt, the Statue of Limitation is valid and that they have a legal right to collect the debt. All of which would be required for them to get a judgement anyway
