View Full Version : Minor's Sur name change.

I lived in California up to a month ago, and now reside in North Carolina.
I have a 10 year old daughter, she was physically and verbally abused by her father (my es husband). I received a court order where he can never contact her again. She hates her father, and we have no contact. She has suffered emotionally. In California I was able to change her last name through the school system, with a form that allows me to do so if child was abandoned by parent, as she was. I moved here to NC and they don't recognize it. So I go to court and they won't allow me to change her name, as their law here states the father must agree or be dead.
My daughter has used my last name in California for the last 3 years and has established it. She comes here to NC and has to revert to the name of the person she hates. It is taking a toll on her and myself. She is 10 years old.
Any suggestions on what I can do?

Hire an attorney, it should be able to be done. Some of the NC judges live in the 16th centurary and women and kids should still be property to some of them. But you should be able to make it happen. If not do what Hilary and some other do to run for office, set up a "residence" in a state that makes it easy to change at court, and do it there.

Yeah well I am already planning to fly back to California and handle it there, if I cannot do anything here. Seems ridiculous but its important.
