View Full Version : My moms boyfriend won't leave

My mom has 2 kids with her boyfriend of 9 years and she is fed up and wants him out. He says he won't leave because he put a lot of work into the house. His name is not on the title. She has no clue where to start or what to do. I've never been in this situation so I'm not much help. Does anyone have any advice on where she can start? We live in Nebraska.

Google "Eviction laws Nebraska" and you will get a number of links like this (http://www.rentlaw.com/eviction/nebeviction.htm). Essentially, in Nebraska or anywhere else in the U.S. she will have to give him a notice to quit and, if he doesn't leave in the time given, sue him for a court order that he leave.
By-the-way, she will probably also want to sue him for custody and child support now, while she still knows where he can be served with process.

She has to follow the rules for a legal eviction according to Nebraska law.
Without looking it up... she tyically has to have him served in writing with a 30 day notice to vacate... if at the end of the 30 days he has not left, she files with the court to have him evicted by the Sherrifs office who will come and put him and his property out of the house... then and only then could she have the locks changed. Right now he is legally a tenant.
If he gets abusive or threatening before then, do not hesitate to call the police.
