Mine is a complicated one. My ex wif and I married in Alaska when we were in the air force. Not to long after that we had a son. The marrige went south and I left atfer my four years. I could not find her or my son for 3 years when she contacted me. She had moved to Texas got the devorce and called me to tell me it was done. There was no leagal separation and some how she had back child support included in the devorce. She vanished again and I could not find her. I needed to find her to remodefi my support/ she has it at $600 a month. 350 for regular support the other for back and medical. I can't get any help with this. No one want to tuch it because she live in Colorado and I in Ohio. I can't afford an atterney. My wife now has been helping me every way possible to fix this but to no avale. I think it ould be easer to give up my rights.so at least I can just get on with our lives. I have no contct with my son with her unless she useses him to get money. What do I do?Can I give up my right under this situation? HELP!

First, forget about giving up your rights. Even if you got a court to issue a TPR (highly unlikley), it would not affect your support obligation.

I'm going to guess what happened here. You abandoned your family when your enlistment was up and left. You didn't keep contact with them or they didn't keep contact with you. Your ex then decided to get a divorce. She either didn't know where to find you or lied about it. Either way she was able to satisfy the court where she filed that you had abandoned them and was able to get a divorce with child support award by default.

At some point she was able to locate you or the support agency did and started collecting support.

So, 1) you don't need to find her to fight support. You need to go to the court that issued the support order and apply there for a modification. You can ask the court to serve her through the support agency if you can prove she is hiding from you. (though you seem to know she is in CO now). However, if she has moved since she didn't know where you were, she can have jurisdiction changed to where she lives now.

You messed up by not filing for divorce before you left. Now you are paying for that mistake. You will need to hire a local lawyer with affiliates in the state that has jurisdiction.

No you can not give up your rights, and child support is not a right, it is a obligation, rights are ability to visit, perhaps have a say in child's life.

Next when you send a check to the court, it goes somewhere, they have her address. And you can go though the courts, to find out where she is and to get visitation with the child.
