View Full Version : Can my step dad kick me out?

I'm 18 and living with my mother and step dad. My step dad despises me because of my black fiancée. He also hates me because I refuse to be his round the clock maid. My mom is very sick with copd and can't do too much. My questions is can he legally kick me out and if so how long will it take?

Does he own or lease the home? Or is it in your mom's name? The owner/ tenant would have to evict you. If it's both of them, one or the other could, probably.

Assuming, of course, that by "kick out", you mean taking you to court and getting a judge to order you out.

I'm curious. Did you imagine that simply because he is married to your mother, you can stay there, as long as you want, whether he likes it or not? You are considered an adult in just about all parts of the U.S. So you have no right to stay where you aren't wanted, parent's place or not.

Who does the housework, the dishes, the laundry, the cooking if your mom can't?

Rather than get kicked out, seems like it would be easier to work out a reasonble plan with your stepdad for caring for the house and your mom.

A key question: are you paying rent?
Who is buying food and so on?
If no rent, then you should be paying rent in the form of a few hundred dollars worth of extra work around the place, in addition to your usual share.
When you are young not a lot of that matters to you, but it does to them, so either chip in financially or with work.
Try getting your own place - living is EXPENSIVE!

I think it is up to your mom and father. They should have a dicussion. And you should talk to ya dad.

I know you mean well but we pride ourselves in proper legal answers, Please do not guess on answers.

Her DAD is not part of this, it is her mom and step dad that are at issue here.
Normally if your mom is still living in the house, he can not evict you without her permission also.

But then I also have to ask, what do you do around the house, if you mom is ill, a 18 year old daughter in the home would be doing a lot of the chores around the house, and perhaps even paying some rent.

So more details about what you have to do, and how you help out is needed.

I would like to see an "adults only" heading on the legal boards. This person is 12.
