I was caught shoplifting at jcp worth 115$ was arrested went to jail and was released on a cash bond and I'm waiting on my court date . Charged with misdeamor class b Texas and this is my first and last . I also had had my 2 1/2 year kid with me but he knows nothng bot this . Now I don't know what to do I'm assuming since it's the first time I should probably have some community service or pretrial or fine may be
But if I'm pregnant then what would the charges be?
Usually how long does the court date comes? I mean how much time does the court take to send dates? Till then I'm supposed to call the court weekly
. Dono what to do as this is haunting me so bad I know its my fault I
I admmitted to the cops and loss prevention officers that I didi it and said will never do it again
. Will the court dates come or is there a chance that the dates don't come? Or do I appoint a lawyer and request a court date is a bad idea to get the name out of thr record when the name actually didn't appear?? I'm not on green card nor a citizen
Please help and please tell me how long after the date will the process for misdeamor last?

Ok, some judge may feel sorry for you if you are pregnant, others will be a lot harder on you since you did it, with a child with you.
You can expect even with diversion a probation from 1 to 2 years along with fines.

Presently I'm not pregnant... thats the second thing if I conceive then... but how long do I have to wait for the court date to come its been a week since this happened. Usually what is the time for court to send dates? Is it better to get the date oe better if I don't get a date . If so what would be my charges?

You will get a notice of court most liklely within the next 6 weeks, and have a time of about 3 months before the date of the trial.
You will appear, and you plead not guilty and ask for an attorney to be given to you. You can also ask the clerk of the court if they can supply you forms before hand to ask for an attorney
** if you can't afford one, each state has its own rules on what they consider ability to have an attorney.
Or of course you plead guilty and then the judge will sentence you.

After arrainment how many days does it take for trial date to come in Texas. Do the court have a time limit for first time shoplifting misdeamenor class b.
What happens at my arrainment ?
What could my charges be ? I'm trying to get my case dismissed. Got an attorney appointed.

AT the first appearance you will be read your charges, or waive hearing them read you will be asked to plead guilty or not guilty. If a plea deal has been arranged it will be handled..
It can take from 3 to 6 months normally to actually have a trial
Are you sure this is a first appearance , arraignment you are doing and not the actual court case.

I have my arrainment next week . And I'm going to plead not guilty. Have a lawyer appointed so what's next?
If the case goes for trial how long does it take for the court date to come?
Do we have sppedy trial?

You should be talking to your attorney who will talk to the DA and they work out a deal, It can be done in the back of the court room must will normally happen after you plead not guilty.
Normally on shoplifting, if you walked out of the store with it, or put it in your pocket or purse inside the store, or in Texas even walked past the cash register toward the door, you are guilty, so most people just pay the fine and move on, or at the hearing, their attorney asks for a first offender program, you plead guilty, pay fines, do probation and then the record is sealed.
Trial most likely 3 to 6 months after the hearing ( and that is if you are lucky normally) speedy trial is oftan sooner than a year .

So you mean to say that after arrainment itself it can be sorted out.? and my lawyer said if they don't agree he would like to take the case to trial. Why does he want to take the case to trial?
The amount I stole is 120 dollars worth that I stole and already paid the fine to the store of 400 dollars.
He once told me he would like to get the case dismissed even before it enters the plea bargain what does he mean and when does this happen?
