View Full Version : Is it illegal for a 16 year old to date a 13 year old

My son is 16 and turning 17 in May and his girlfriend is 13 turning 14 in Sept.
I am wondering what might happen to my son if they become sexually active. At the moment they are not. They have no intention of being sexually active but as I am fully aware many people feel it is inappropriate. The school they both attend has been making it very difficult on them. As well its seems they have contacted CAS because they felt it was there duty to report.
Is this the case? Do they have a legal duty or are they just being a pain in my side.
Is there anyway legal action could be taken against my son? Does this relationship fall under any laws like statutory rape in Canada?
Please give me as much information as possible, I need to make some changes and I would like to have the resources to do so.

Honestly, I know nothing of law in Canada, so my answer is based off information in my own country, the U.S. Under the rules here, a relationship like that's is not illegal or necessarily against the law so long as the parents are able to speak for the couple and both young people's parents can show that they give sconsent to the relationship their child is in taking place. However, sex is a tricky subject. There are so many ways things can go wrong... parents usually won't even let their kid get near the relationship. Any kind of accusation the younger person makes could potentially cripple the other person's future. So, to try and answer you the best way I possibly can, I think you should make sure that her parents know what is going on and are fine with that. Next, make sure your son does not do anythign stupid. This cannot be done wrong, because if you try to make it look like you are telling him not to do something stupid, he'll do it anyway, because it will suddenly become something adventurous and thrilling. I'm seventeen, which would usually make people call me 'inexperienced,' or 'naive,' but I have two friends that have been in the same situation your son is about to get into, and all I will say is that it is very delicate in my country. Yes, he will be arrested and be a sex offender for the rest of his life. In fact if he even touches her improper even though her clothes he could be arrested for molesting the child.

I would hope they would report it, and as a parent the parents of the 13 year old would report it.

Normally one of their friends report it when they get mad.
