Can an exfelon get a real estate license

It is not likely... however, there ARE exceptions. Firstly, check your state website on the subject. One major factor... what is the felony for? IF the felony had anything to do with embezzlement, fraud, or extortion especially if it was in an Industry like Real Estate, Mortgage or some other Financial Institution... the chances of redemption is slim to non, and Slim just left town. They will also NOT give any second chances to someone with felonies of a violent nature, especially if it involved a child or a weapon.

However, if it was a minor felony (if that's even possible) as far as Felonies go... like a No Victim felony (possesion perhaps) - one may have a better chance at convincing the RE Commissioner that the person who committed that crime is no longer that kind of person now, and be able to back that up with affidavits and testimony to prove it.

If you are serious about pursuing a career in this Industry, and the felony is not in one of the forbidden categories mentioned above... then I suggest you contact a criminal lawyer for further advice on how to pursue it. There are steps that can be taken or suits brought into court that allow you to demonstrate your redemption since the conviction to a judge, that can vacate or admonish the conviction. Basically, wipe if off the record. That way, when you go to get your license, pass your test, and submit your fingerprint card for a background investigation... it comes back clean. If you go this route, also consult the lawyer on how to proceed with filling out the application for the license, whether you have to answer YES convicted then explain that is was reversed... or do you not put it at all.

I would consult a lawyer BEFORE anything else. I think it would be a shame if you pay for classes and use time to get to the point you will test and get a the license only to be stopped in your tracks... frustrating. Not to mention, if you go through the motions and attempt to get licensed with an explanation about the felony... they will most likely store the info in the computer under your social security #... and if you go back and fix everything and apply again... it will be flagged because it will pull up the past record.

Hope this helps. But again, check with your state DRE, even call in and ask a bunch of questions... they don't make you identify yourself.
