View Full Version : Need legal help I think- how do I get my inheritance?

I lived with my aunt and uncle from third grade till I was 17
He sexually abused me for four years, and she basically mentally abused me the whole time I lived with them
So as you can imagine I want nothing to do with them at all
Well she (my aunt) was my grandma's daughter. My grandma died in 2007, and she gave my aunt, my dad and I all a piece of what she had left.
I was left a bank account in Boise that I couldn't open until I was 18.
When I was 17 I moved to Central Oregon.
I have contact with my dad, but I can't really on him to help me out, he's kind of a drunk, OK he's really a drunk, but I love him.
Anyway my grandma never had her will (I don't know the term) but it wasn't legalized or anything. She left my aunt the power of attorney.
So now, I need to figure out how to get the information that I need so that I can get the money that my grandma left me and obviously I do NOT want to talk to my aunt.
I haven't talked to my aunt and uncle since he went to jail (he got 6 months that's it! How f'ed up is that?! ) and I moved away.

I am 20 now so I can of course get into that account if I can find it.

So my question is who can I contact to get anywhere on this. I have no clue at all what to do so anything I can get would be a great step

The Power of Attorney ended when your Grandmother died. A P/A dies with the person, so to speak.

In Idaho if there is no Will - and apparently there wasn't - property passes to: If you are married your possessions are shared by your spouse and your children. If you have no spouse of children, THEN AND ONLY THEN do they pass to your Grandchildren.

As long as there are living children - and apparently your Aunt and Father are her children, they inherit and you do not. Maybe you were promised money but without a Will that is not enforceable.

You can get an Attorney to communicate with any/all of the parties but by law you are not entitled to automatically inherit when there is no Will.

If there was a bank account left to you by some other means, yes, you can collect it now. An Attorney can locate the account.

Your aunt is not now operating under a P/A
