My ex and I have joint custody but she has majority custody, in part of the custody agreement it says. "SUMMER: Each party shall be entitled to two one-week periods of uninterrupted custody during each summer, which weeks shall not be consecutive unless otherwise agreed by the parties. This shall be accomplished by each party giving the other at least 30 days advance written notice. In the event of a conflict the party first giving notice shall prevail." On 4/9/12 I sent her a certified letter saying I would be taking our son with me on vacation from 6/9/12 to 6/15/12, I would need for her to meet me at 8 PM at our meeting spot cause we are leaving early on 6/9/12. We will be going to the Outer Banks in NC. We live in PA, I got a call from her on 4/10/12 and her leaving a message on my voice mail saying that is her weekend and I'm not taking our son out of state that she isn't approving me taking him on vacation with me. Can she refuse my vacation time with our son cause it is her weekend? And if she don't let me have him will she be in contempt of the Court Order?

Is the time your wanting the first week of summer vacation for the child? Is there anything stating which parent has which week? Some have alternating even odd years written into them. You may need to check your order to make sure. If this is a brand new order then your going to have to work the kinks out. If this is an old order then the courts may follow what has been track record for you both. The giving of notice appears to be for the times your (either party) takes 2 consecutive weeks of vacation time.
