My husband is in the witness protection program, the US Marshalls gave him a new birth certificate and social security, and was told that his old life no longer exists, does that mean I am no longer married and if so how do I file for a divorce

Um... you are sure he's in the program? Wasn't you offered a chance to go with him?

Yes I am 150% sure. As as I mentioned in my question we are not together, we have not been together for over 17 years, we have both moved on a long time ago, however due to the circumstances, we were never able to resolve this matter, we do not keep it contact at

I had to ask because I've heard people come up with some really good excuses over the years...
You should still be able to file for a no fault divorce some places... in some places you don't even need the other persons approval or agreement. I'm not exactly sure how it works... but when you can't find the other person to serve the papers to, publishing a notice in a local paper can suffice... but I'd recommend consulting a lawyer familiar with the laws in your state.
You might also send a copy to the FBI as they will know how and were to get it to him. They should know who is in the program and where... at least the select few that deal with that stuff.

Yes you are still married, you may file for divorce and list him, he would be served by giving service to the Federal Marshal Service ( look up the department over the witness protection program)
But again, no that does not make you divorced. And depending on what bad guys are looking for him, it actually makes you a target since you are still his wife.
