View Full Version : Rights after dna without being on birth certificate?

What rights does a father have if he is not a birth certificate? I am letting him come and go to see his son as he pleases but lately he has been choosing friends and drinking over his son.. And child support recovery unit has court ordered that we do a dna test so that they can get back the money that I am usen for medical from state.. So I guess my question is does the fathers name get put on birth certificate after a dna test in Iowa and if not what rights does the dad have with just a dna test being done if he is not in his sons life unless he wants to be when he is always able to?

He has no rights at all until/unless a Court determines he is the father and gives him rights - primarily visitation. Why aren't you pursuing him for child support?
Why, for that matter, are you allowing him to see the child when he "drinks as he pleases"?

A DNA test, although usually very reliable, does not carry the force of law unless paternity has been adjudged by a court of law. So, unless there is a court order, or the BC has been changed to show he is the father, he doesn't have any recognized rights.

In NY - and I realize she is not in NY - the birth certificate is not changed unless the father, following DNA, petitions the Court for a change - and then it's still often denied.

The court ordered me dna testing cause if his request , the test came back he is the father . Do I have to put him on because ? And what rights does he have ? We only went to court for child support . Now they are going back to birth because he said he wanted dna test . Worried he can just take off with my kids ? Can he do that ? Thanks
