What rights does my daughters father have even though he signed the birth certificate? He is no longer living with us, has not contacted us at all in almost a month after moving out, she is 7 weeks old, live in Ohio, I am 34 and have a full time job and own my own home, he has no home, not sure where he is staying, is a window washer, works just to get by.. has had other child support issues with 2 other children who are not mine.. Has been in and out of jail because of and for OVI? What's can he do legally?

Everything any father can legally do... including getting custody if the court awards it. He is the father. He has the same rights the mother has. And who is or isn't in the birth certificate has nothing to do with it... DNA trumps a signature.

Agree with Smoothy. In the absence of a specific court order, both natural parents of a child have equal shared right to custody of the child.

So, you need to go to court to get full legal and physical custody of your child. Just because the father isn't exercising his rights does not mean he doesn't have them.
