He has played an active role in her life except when incarcerated for six months. Can I move out of state with her and not be charged with kidnapping? There are no court orders.

Absent any court orders you are free to move. As long as you don't hide from him, you shouldn't be charged with kidnapping.

However, he can file for custody before you can establish residency in a new state and this may force you to return.
