View Full Version : Can a green card holder also hold a h1

I don't know if my husband has received his green card or not. When I enter his receipt number,it says "card/document production"... Due to marital issues he wouldnt' reveal if he had received one. All I heard him say was that he was eligible to stay & work in the country... I know he was somewhere in the I485 stage & he was due for his GC any minute. Though we are married for 11 months, I joined my husband only 6 months later on h4 visa. My questions are as follows :
Is it possible that he already received his GC ? If he did back then was it legal for him to have had a h1 simultaneously. Or if he received his GC after the H1 was applied , then will it be dropped once the GC arrives. If that is the case what happens to my H4 status?

Assuming he hasn't received his GC, if it's in the final stage , would he still be able to append my name as a spouse??
I am currently in US since 6 months now & we have a son born in the us.

I heard that one could file for something called an I130 form for spouse. How does it work & how long does it take to get a GC then??

If my son is a citizen & my husband a GC holder / I485 final stage , is there any other alternative to stay in the country legally?

Will an F1 visa help to hang in the country if my h4 validity lapses. In which case do I need to go back to india to apply for f1 or can I proceed it for it staying in us itself??

My knowledge of the visas/ forms is nil. Just in case my questions sound naïve, please excuse.
