My niece has a 12 yr old daughter from someone she was never married. After 9 years he has decided to ask for visitation. He has been in and out of jail for the past 10 years and has no redeeming qualities. Her daughter is deaf and does not know this man except for a few times she saw him at his father's home. They went to court and the judge did not care the least about his past or the fact the he has never paid in support or made any attempts to see her. He ordered everyother weekend for the child to spend 24 hours with the father. She went one time and did not want to return. The weekends that he was to have her, he would show up and she would tell him that she did not want to go, he would call the police and cause a big drama. He does not know sign language or is he trying to learn so they communicate by writing. They went back to court beginning of March and the judge interviewed the child and she said she did not want to go with him but the judge ordered her to see him 10-4:30 every other Saturday. The first day he took her to lunch and she asked him why his other 2 daughters (from other women) do not like him and why he did not tell her mother he moved. He became irate and grabbed her cell phone and called my niece and screamed at her that she was feeding the daughter with stories. The daughter has contact with her half sister by Facebook and they see each other occasionally. He brought her back home at 1pm and caused another scene and yelled that she does not have a father anymore. They are not due to go back to court until June and my niece would like to resolve this sooner. She does not want her daughter going back since he frightened her by his actions. The judge amazingly seems to side with this low life sperm donor who also is very disruptive in the actual court room. The judge was going to have in arrested the last time because he would not shutup after the judge repeatedly asked him to stop. Yet the judge still disregarded the 12 yr olds feelings and made he see him again. What are my nieces rights and can she request another judge. Also, this is being held in civil court in Santa Ana. Judge is McMartin?
