View Full Version : Hit and run but son was ticketed for failure to control--Ohio

My son was run off a dirt/gravel road by a young man who threatened him 2 times earlier that week. There is a mark on my sons bumper (drivers side rear) where the other driver bumped him with the tow ring on the front of his truck. The hit and run driver sold his vehicle just a couple days after the accident. My son was ticketed for failure to control because the officer said there was not enough evidence. Also the other driver came to my house and threw a M-80 at my house a couple days after the accident. Can we fight this ticket?

Sure you can fight this but what did you do about the M80, call the police? Get a police report started and have your lawyer bring it to court along with pictures of the car, bumper and roadway.

Sure, find the car that hit you and get photos of the damage. How photos of the damage that could not be done from the accident.

Yes there are police reports about the harassment, previous threats, and the M-80, we are also filing for a restraining order. I have pictures of the car/ the drivers truck and the roadway / close up pictures of the tire tracks and the tree that my son wrapped his car around. Close up pictures of the damage to my son's car etc. The officer would not consider them. My son is lucky he is not dead.

Don't just fight the ticket. Talk to the local prosecutor about charging the other driver with assault, attempted murder, etc. This is clearly more serious than a moving violation.
