View Full Version : I received a summons and complaint that both require answers. How do I do that?

My ex wife was awarded the home and all financial responsibility associated to it in the divorce. I received a summons from the court and a complaint from the plaintiff. Both of these require answers. My question is to answering the summons. How do I answer this as there is really no form to the letter other than a few paragraphs?

What does your divorce have to do with this?

You were served with a summons (signed by the clerk of court) and a copy of the complaint, which was signed by the plaintiff or his attorney. The summons instructs you to file with the court an "answer" to the complaint. A complaint and an answer are what are called "pleadings". A complaint is not a "letter".

Answer the complaint by addressing, in the same numbered order, each numbered paragraph of the complaint. Generally, "admitted" or "denied". Also write any "affirmative defenses" you want to claim, like statute of limitations, etc.

Goggle "[your state] rules of civil procedure". The rules will give you more information.
