View Full Version : How do I pursue what is owed to me? Has anyone previously faced this?

Recently, my family (Mom, two sisters and myself) were to receive money for auctioning of the shares from my dads construction company. The shares were auctioned for 200k. My mom was dealing with the lawyer. It took us three years to get through probate. My mom had me and my sister put a couple signatures on a packet of papers, telling us that it would expedite the probate. Supposedly "the paperwork was taking more time" and my mom said she would tell me when she heard anything. Four months later she moved into a new house and bought a new car. I'm not allowed to live there nor am I allowed any of the money. I had been planning on enrolling in college and finishing my degree. I have no car because I gave my car to my mom. Her transmission went out in her car before this, she didn't have the money to fix the transmission, and she had a good job. I had just finished my term in the army, so I did not have a job yet.

I don't understand where you think there's a problem. Are you saying four people were to receive the proceeds of the sale (you, your mother, your two sisters) and your mother kept all of the money and gave you none of it? I am guessing that this is a provision of the Will?

Were there assets other than these shares which your mother used to purchase the house/car/anything else?

No one can force her to let you live with her. If she took monies which do not belong to her she CAN be forced to give your share to you.

You signed papers without reading them and don't have a copy? Go to Probate Court (or whatever it's called in your area) and ask for copies of the paperwork.
