More detail, as in WHICH state, how long, how much in salary, etc.

Hi, thank you very much for your quick reply.

I lived in DC for the first 5 months then moved to VA.

I'm having problem to calculate my deductions and exemption. I chose itemized deductions on federal tax return because that's the one applies to my current status. So I'm claiming itemized deduction on both of my state tax returns. When I was trying to follow the instructions for D-40, the line b on the calculation D chart (DC Itemized Deductions for Part-year DC Resident) requires me to enter portion of line a which is total itemized deductions from Form 1040NR-EZ in my case . My total itemized deductions on federal tax return are actually my DC and VA taxes. So this will make my DC itemized deductions zero. Is that correct? My income earned while I lived in DC is 5k.

As to my VA tax, it seems like I also need to file Schedule I along with 760PY. Is that correct? The staff from our university's tax department suggested me to ask a tax accountant for help since part-year resident VA tax could be really tricky.

That IS a complicated issue, as it depends on how DC treats itemized deductions. I do NOT know off-hand (as I do not practice in the DC area), but if I had your W-2s and was doing your return with you as a client, I would be able to figure it out.

I am on F1 doing OPT from India.
My W2 shows for 2011 shows
Wages $ 50,000
Fed tax withheld $8833
NJ state tax $ 1679.20
SUI/SDI $ 273.80
Can I claim any return ?
Am I entitled for standard deduction or can I itemise?

Hi Joyel,

I believe students from India are entitled to standard deduction for your first 5 years in United States.

It is my understanding that you must file your Federal tax and state tax even if you are nonresidential alien status. Once you complete the forms, you will know if you will get any returns or you actually own the government money.
