My son's father is a registered sex offender, there is a no contact order in place, he never signed the birth certificate, does his father have any rights to my son and do I need to file for custody or do I automatically get sole physical custody of my son. Our son is the reason he's a sex offender. He got me pregnant when I was underage at the time.

Right now with a no contact order and not being on the birth certificate, he has no rights. But that doesn't mean he can't get them.
You don't need to file for custody, since he isn't on the birth certificate. But given the nature of his offense, he is probably listed as a lower tier offender. Depending on the ages and circumstances involved, having sex with an underage girl might not make him a danger to your son. So, if he goes to court to file for partial custody and visitation, it may be granted.
But there is nothing you can do until and unless he does file.
