View Full Version : Eviction of person not on a lease

How do I go about evicting a daughter-in-law from a house we own. We live in Iowa and our kids have been allowed to live in a house we own. They are splitting up and has issued a restraining order against our son, so he can't go near the house we own. They do not pay rent and are not on any kind of lease or legal document. She has been asked to move but refuses. Is she trespassing? What rights do we have to take back our property?

She is a resident which gives her the same status as a tenant. Don't "ask" her to move. Give her a written notice allowing her 30 days to vacate. In the notice state that if she is not out by the deadline, then you will be forced to filing in court for an eviction order. Then do it.

Go down to the court house and file evition paper with the clerk of court. It will take about 15 days to get her out of your house.

Nahhh. That just isn't so. Scott knows his business. Without giving notice, an eviction lawsuit won't be entertained.
