View Full Version : Neighbor harassment NYC, what rights do I have?

I move in my current apartment with my spouse and two children ,4 and 8, the summer of 2010. About a three months after we moved in my down stairs neighbor came to my door at 7:45am on a Saturday morning and reported my kids were making too much noise, at that time they were sitting eating breakfast. From that moment on the neighbor has repeatedly reported my kid to security stating that they are up at 3am every morning making too much noise, my kids are in bed by 8:30pm daily. When no one is in the home she complians that noise is coming from my apartment. Back in October I received a notice from housing to keep the noise down or they would kick me out. When I confronted housing about the letter and the lack of investagion to see if the noise was happening they reported that there is no way they can prove or disprove the noise but they must send a notice.
After our conversation security was instructed to come to my door whenever the neighbor had a compliant as long as it was before 4am. A few months later I was awaken by security at 3:30am stating they apologized but the neighbor complianed about the kids again. Seeing that no was us up at the time, they dismiss the compliant. The security documents every compliant and if vaild when looked into. I asked due to neighbor multiple compliants and none proven could they send her a letter. They reported to me they could not because it was only proven at the time when security arrived there was no noise. I reminded them they were able to send me a threaten letter only based on the neighbors word but yet could not send her a letter.
The neighbor came to my door again recently stating my kids were making too much noise. She also complians about noise when we are away for the weekend. Is there anything I can do about this contanst harassment and the housing office unwillingness to assist me in this matter?
