I don't know why this is posted in Small Claims.

BUT - what State or Country?

How do you know the person selling it actually owns it without a title? You don't.

I'd move on asap. Is the truck plated, if so someone has a title and apparently not the guy you are dealing with.

Unless this is something like a 1930 truck where there were not titles, you can't get a plate. The bill of sale is not enough. You do not actually buy the truck till they sign over a title to you. Sounds like someone is trying to scam you

As others have said - if the person trying to sell the car doesn't have the title then he's not the owner. So after you hand your money over you won't be the owner either. If he is the rightful owner he can get a replacement title from the state DMV, then sign that over to you when you buy the car.

Also - make sure that the bill of sale stipulates a few things that will protect you: that the seller is the lawful owner of the car and he has the right and authority to sell it; that it is free of all liens, encumbrances, taxes and fees; that he will defend and be held fully responsible for such lawful claims and demands that may arise with respect to his prior ownership of the vehicle, if any; and that he certifies that all information in the Bill of Sale is true and correct to the best of his knowledge.
