I have 19 month daughter and her father has been in prision since I was 7 months pregnant and wasn't able to sign her birth certificate and has never did anything he has a long criminal background of gun charges and armed robberys and I just don't want him in her life. Now he wants to take me to court for visiting rights can he do that? And what can he do?

How does he plan to exercise visiting rights if he is in prison? Are you saying he just got out?

If he is out of prison, he will prove he is the father and file for visit, if you prove he is a danger to the child, you may get it as required supervised visits. Also you may ask for counseling before visits to help make adjustements

Hes not out yet he gets out in 90 days and he's saying that's what's he's pre-paring to do.

What if I file a restraning order against him?

First you have to have a legal reason, next that would stop him from seeing you, so the exchange of kids or supervised visits would be done without you present

You will have to prove the father is a danger to the child. The court is going to look at the fact that you had a relationship with this man and had sex with him. If he was good enough to have sex with, why isn't he good enough to be a father.

Unless you can prove he's a danger, then he will, in all likelihood, be awarded some level of visitation.
