View Full Version : Father rights to seeing newborn children?

Hi, My daughter is now 9 weeks old. This week I have split from the mother and she has now told me "I will see my daughter when she says I see my daughter". So Just would like to know what rights I have for seeing my daughter. I'm the biological father and my name is on the birth certificate with my daughter also having my surname? If anyone could answer this, I would be very grateful.

Unless there is a court order in place whereby there are certain visitation rights outlined by both of you. You are the bio, you are named on the because as father, yiou have every right to see your daughter. Are the two of you married?

In any case she is wrong.

Is this just a spat, a whim on her part?

You have rights but if you are in the US you need a Court to order and enforce them. If the child lives with the mother without a Court Order the mother gets to make the decisions.

You file in court for a very specific visitation schedule. The court will tell both of you when you can see the child.
