My sister passed away last year and her husband's career requires him to travel extensively. The relationships between all parties are excellent. We are looking at the opportunity to have my nephew live with us for continuity of family and schooling. Our questions are similar to others regarding our rights as parents to enroll him in school and deal with health care. Can we enroll him in our health insurance? Do we need a power of attorney? What are the financial costs? What are all the things we need to consider and discuss with the father so that we are all clear and working together in the best interests of my nephew?

An order of temporary guardianship is your best bet. This will give you the right to seek medical care for the child. Why would you need him on YOUR insurance? Doesn't the father have insurance? You may need a POA to file claims against that insurance. I would check with the insurance carrier to find out what is needed.

It would be best to have an attorney draw up the guardianship agreement to protect everyone's rights.
