Me and my wife are raiseing a child that we have had for two years now,the mother hasent been seen at all for six months now.last any body new she is in and out of homeless shelters,mental wards,and hospitals for fake symthoms,a lot of over doses of medican.she is been investgated for state froud of walefare.we want to know if we should file charges agnist her?
We have tried to get bennifets for him and can't that is how we know she was using the child still,wven though we haven't seen her in six months and have provided total care for him for two years now.

No, you can't file charges against her. You can report her to Child Protective Services (or a similar) agency and let them (and the police) file charges against her.

If she is getting benefits, report her to the people paying those benefits.

Do you have legal custody? If not, you could lose the child. You need to make the arrangement legal.

First no you do not file charges, you may report her to medicare or medicaid or what ever agency she is claiming the child with. But she is still the legal parent and it appears you where never given any legal right to the child. You would have issues even getting medical care for the child.

Next it is not abandonment, she left the child with you, abandonment is leaving them in the mall or shopping center and driving off. She appears to make sure the child is well cared for..

If you do not want to keep the child notify Children services to come get the child.
If you want guardianship, file in court for it.

We had temp.guardenship for six months,it has ran out ,we want to make him a permanet part of our family how do we go about it?
Lawyers want 2,000 dollars down we can't do that but we could make payments, but no one will let us, we don't want to ever loose him

Start putting money in the bank, ( make payments to yourself), and then pay the attorney, yes you will need an attorney and most likely it may be more than 2000 dollars

Can't you just renew the temporary guardianship? How did you get the temp guardianship?

You went to an office and some bureaucrat looked the child up on a computer, turned to you, and said "sorry, ____ is already receiving benefits for this child."? In that case, I expect the agency is already investigating the mother for fraudulently receiving benefits.

First, since you were awarded guardianship, even temporary, there is no case of abandonment. Second, if the mother is still receiving benefits for the child, then she is committing fraud and should be reported.

But you really are giving us very little information to help you with. What is your relationship to the child, the mother, the father? How did you get awarded temp guardianship and under what conditions? What is your general area (ANY question on law needs to include your general locale as laws vary by area.)?
