Hi just a short note I tripped over a shop doorstep last Friday on the 09 03 2012 and injured my knee the owner of the shop told me last Saturday 10 03 2012 that the step has now been painted as I went past the shop yesterday the step is still the same with no warning that the step is there do I have a case to take up and take this matter further yours sincerely g haynes

Where? What are your injuries? Can you sue the shop for not warning if you weren't hurt? No. It's about the medical costs, lost work, other expenses.

I'm a liability investigator. A LOT depends on where you are but most of this depends on your injuries, the dollar amount of the treatment, what the prognosis is.

Has the store agreed to pay your medical bills from this injury?

If you can prove other people have tripped and the owner did nothing, then you may have a negligence suit (assuming you were injured and incurred expenses as a result of the injury). If you were the first to trip and someone else gets injured then they would have a case, not you.

The fact that the step has not been fixed since your injury has very little do do with your right to recover for your injury. It may prove carelessness or something on the part of the owner, but basically you can recover for your injuries, but cannot force him to fix it.

As a matter of fact, now that you know about the dangerous condition of the step, don't think about getting injured again. That won't fly.
