View Full Version : Grandmother trying to keep custody

I am a grandmother of a 6 year old since he was 2. His parents signed legal custody over to me because my son was in jail and his mother was "jumping" from house to house. After 4 years the court had asked them to pay child support. After she got the letter she went to court to try to get his custody back. Now, we are going to a custody hearing so that the judge can decide. I am nervous and do not want to lose my grandchild. Will the court be in her favor?

This is a tough one and I do not want to be flippant about it. I think you need to speak with an attorney. This is the type of thing that is too important to get legal help over a message board. It really depends upon the circumstances. A judge will listen to all sides and you may not legally have certain rights. Unless I knew more, I would be reticent to advise you.

You should have an attorney, often the courts will want to get a child back with the parent. Will the mother be able to show a stable home now. Has the mother been visitng with the child

After 4 years, a court is not likely to change custody unless the mother can show a compelling reason to do so.

But you should have an attorney especially if the mother has one.
