But I'm 16 in one month and he's 13 in 5 months but is that okay to date aslong as we don't have sex till over age.

There are no laws against dating, as long as his parents and your parents are okay with the two of you dating. If his parents aren't okay with it, then you could be in trouble.
You're both still children. Neither one of you are old enough to consider sex, so I would really hope that sex isn't even a consideration.
But dating, you have to ask your parents, and he has to ask his.

Yes, I think your friends might give you a really hard time... but if you feel like the emotional gap isn't as big as the age gap then I don't see the problem.

A 12 year old is out of their age and emotional level trying to date anyone.

I can't imagine what you have in common with him. Bear in mind how much longer boys take to mature than girls.

Emm, as the others have said, with parental consent dating without sexual contact is okay . However, I would need to know what state or country you live in to know what the legal boundaries are when it comes to sexual contact. Some places have laws against touching and kissing if the intent is to arouse. So you could cross a line even if you aren't having sexual intercourse.
If the parents say 'no'. Do not try to go behind their backs. If they find out it could end up damaging the trust they have you. Losing your parents' trust would not be a good thing.
