Hello,
I am a concerned godmother and cousin that would like insight on some legal matters. Here is the story:
My male cousin (let's call him Ramon) had a baby with a girl that was in foster care (let's call her Madison). There baby (we can call her Belle) has been living with me pretty much her whole life. Legally she has been living with us for about 3 months, give or take, because my mother adopted Madison, solely, for the interest of Belle. While Belle was staying with us, before it was official with the state, Madison would leave Belle by our house for WEEKS without calling to find out how her daughter was doing.
Ramon was recently restricted from the courts to see Madison or Belle because of domestic violence between him and Madison. There has been unofficial word of Madison actually beating Ramon too, but I'm guessing because of pride those offenses were never taken to the officials. Charges were dropped so he can now see Belle, however, he still shouldn't have any contact with Madison. I have knowledge of them defying this court order. Madison lives with us and she goes three days (more than once) without anyone hearing anything from her. Madison even called her child a monster because she reminds her of Ramon (because Belle resembles him). I overheard Madison speaking with Ramon saying things like "I didn't want this, remember? Her. I didn't want her. You wanted her", "I would leave her by herself, you know that?" This conversation resulted one morning when Madison and Belle were suppose to be home alone for a few hours. The issue that Madison had was that she would be left alone in the house with her child. She has NEVER, since she has been living here, spent a day in the house with Belle. She is always rushing off to "work" or "school".
Belle is now 15 months and I honestly fear that if she doesn't harm this child physically she will undoubtedly do so mentally. Truth be told, I feel like both of them are unfit parents because they are selfish, naïve, careless, and immature. My argument is that for the best interest of the child, Madison should NOT have legal rights of Belle. Are there any advantages in taking this to court?
