Me and my sons father were never married. My son took his father's last name. He has barely been in my son's life and my family is mostly in his live. Therefore, I would rather my son have my last name. My question is, do I need his father's permission? I live in NJ.

" If the other parent objects, you must provide evidence that shows the judge that the requested name change is in the child's best interests." LSNJLAW - How to Change Your Name in New Jersey (http://www.lsnjlaw.org/english/courts/formslawsuits/changename/changenamenj/)

Forms and instructions are here (http://www.judiciary.state.nj.us/prose/10552_namechg_minor.pdf).

Yes you need his permission to make it easy.
