Huh? Can you rephrase that so we can understand it.

If your husband is not providing a healthy environment for the children, you can leave and file for divorce.Or you can report it to children's services. If you do report it though, there is the possibility the children (if there are 9) may be placed in foster care.

That doesn't make sense. If he turned it back on the same day they shut it off, how has it been off for months? Or are you saying that, when you told him it had been off for months, he turned it on and that then they turned it back off again? How is it that he could have been living in the house and not be aware, for months, that there was no running water?

But, to your main question, yes you can take your children with you and leave him. If both of you are the parents, you share full custody. This means that, until there is a court order, either of you can take the children. So you do need some sort of custody order.

And the welfare of the children is the primary concern. Lack of water in one place, and not enough space in the other place. Both issues, and others, can be considered by CPS (or CPA, or whatever it's called there).
