View Full Version : In WV, Can "father" be sued for paternity before

I have a friend who slept with a girl just 2.5 weeks ago on Feb 19 and 10 days later (Feb 19) she said she was pregnant and it was his. She has been harassing him NON STOP about it. I personally doubt she is even pregnant or that if she is, it's his.. But that's a whole other issue.

My question is, can this girl's parent REALLY have hired a lawyer to come after him to MAKE him take a paternity test at 10 weeks? Or is she just making stuff up (which is not unusual?) Are they just harassing him?

I'm not a lawyer but I know that you can't do a paternity test until AFTER the child is born.
I also don't know how 10 days after she made it with him, she could possibly know she is pregnant with his kid.
Sounds like she's playing games here. If this is the case, she sounds like she is going to cause some major stress in your friends life.
Someone that knows more about this will come along and give better advice.
No doctor will do a test through amniocentesis strictly for paternity due to the risks involved with the procedure. This girl will have to wait until the child is born for a DNA test.

He can hire an Attorney to stop HER from the harassment. I've never seen a DNA ordered before the child is born - as J9 says, it's dangerous.

The father my friend is 28 and the girl is 19 and she is VERY unstable..

The girl is blowing smoke. Your friend should tell her that it is very unlikely she can know she is pregnant after 10 days. So if she is pregnant, it isn't be him. However, when the child is born he will be happy to take a paternity test. Until then, if she doesn't stop harassing him, he will get a restraining order against her.

She lives in West Virginia, he lives in Virginia. They just slept together the 2-3 times on that day and the next.. And it's, ummm.. "unlikely" that he could have actually got her pregnant based on the "ending" so to speak.. Not trying to be vulgar, just giving as much info about this as possible.
Also, on a side note.. She is now claiming, as of Sunday night (March 4) that while in the ER they did a vaginal ultrasound and they saw two gestational sacks. I looked into it and starting at 4 gestational weeks (2 weeks after conception) is the earliest this ultrasound can be done. This was 4 weeks to the day she said this.
I understand that this all sounds so obviously crazy, but my friend is very upset and her and Matt from attached picture won't let up about this. He has blocked them from every form of communication he can this of, and the keep finding new ones, like the Facebook thing attached that is from today (March 6).
Any help to ease his mind would be helpful.

Everything you have said indicates it is highly unlikely that he is the father, if, indeed she is pregnant.
So have him do what I said,
Oh and be more careful who he has sex with in the future.

I would say she is lying, what is she asking for at this point money? Or trying to use this to control him to make him be with her?
Either way, so let the attorneys contact, there is nothing he can do and nothing he will owe till a child is born.

He should stop trying to find info - and he should contact FB and see if they will do anything. I've heard they will; I've heard they won't, both cases from friends who use FB heavily and were maligned.
My question was how old she was when he first had intercourse with her.
Don't you hate it when friends get into these situations and then you have to find answers for them?

She is 19.. This just happened the one visit a couple weeks ago.. She was 19 then also...

They would not be able to see gestational sacs that early, even with a transvaginal ultrasound. If she had gone to the ER, there should be a report on it that would mention dating of the pregnancy.
