View Full Version : Reasons to have a judgement overturned?

My ex husband was stealing my mail and unaware that my car insurance cancelled, 1 day prior my ex husband bumped himself into the side of my truck, when I went to file with my insurance company they told me my insurance cancelled the day before the bump.. I reinstated my insurance but they would not pay for the fake injury, no one was charged in this alleged injury, but now I have a judgment against me for over 100.000 my friend actually driving my truck also received a judgment against her for 80.000. He signed a notorized statement lying about his residency and also the date they have for the accident is 2 months after he actually bumped himself into the side of my truck, also there is a conflict of interest with the law firm... I want to know how easy this will be to overturn...

What exactly do you mean "bumped himself into the side of [your] truck"? Did he run or walk into it and pretend you hit him?
Did he sue you? Did this go to trial? How long ago was the judgment entered?
What state are you in?
Why do you think there may be a conflict of interest?

I suggest you file fraud charges with the police, perhaps he will withdraw his suite

She has a judgment against her - the case has been adjudicated. She has no bargaining power from her end of things.
AK asks some good questions, requests needed info in order to answer.
If the "bump" was intentional the insurance company won't pay. The question is how to have a Judgment overturned. I see no procedural errors on which to base an appeal.

There is too much info missing, how did you lose the case, if you were served and went to court to fight this, what happened?
