View Full Version : Can someone live in one state and do their probation in another state?

My friend was arrested a few months ago for assult 2. He pleaded guilty and was charged with a misdemeanor, placed on probation before judgement (or something like that) for 18 months. He lost his job before the arrest. He lives with his parents in Delaware but the assult took place in Maryland. He has not been able to find a job and he has been vigerously looking... now no money to pay for anger management classes, and approx $4-500. In damages. Maryland tried to get Delaware to supervise his probation so he had an apppointment at the probation office in Delaware. One of the questions regarded using drugs... so he answered truefully stating that he used pot a few days ago. The probation officer violated him. The very next day she shows up at his parents home (unannounced) to do a walk through. There was no problem until she wanted to enter his parents bedroom. His mom stated to the probation officer "that is my room and no one goes in there). At that, the po abruply left. Oh, forgot to mention that when she came in to his house he was in his bedroom taking a nap. She looked at her watch... then looked at him and didn't say anything. I think she was annoyed that he was in bed at 2:30 in the afternoon. He probably should have told her that he was up at 5:30am working around his fathers farm and came home by 1:30 to eat and lay down due to a migrane. But he didn't say anything thinking it was not a big deal. The probation officer informs Maryland that they won't take his case stating that the mother was uncooperative, he was sleeping at 2:30pm, and he stated on the application that he smoked pot a couple days ago. They never gave him a urine test... he just was trying to be honest. Now the state of Maryland requires him to move there within 2 weeks and have A JOB. He has no money, no job, no transportation and no money to rent a room. Can he continue to live in Delaware while searching for employment and report to the po office in Maryland? I would appreciate any information that anyone might have.

Not legally and if they find him living in Delaware they will violate him and send him to jail pending a hearing, Most likely this would send him back to prison.

1. sorry Mother can not refuse to allow him to search her room, she was being uncooperative and that alone will ruin his chance of being transferred. Just telling the truth on the pot most likely may have been let go since they did not revoke him on the stop then, and still searched mom's home.

But at this point he needs to move back, find a homeless shelter or something, or his next home will be the state prison. Mom needs to understand, when she agreed to let him leave there, she gave permission for her home to be searched anytime by a PO officer, and that is the entire house. She was the cause of this,

He is lucky he has not already been picked up and put in jail
