I dated a man since 2010. Last year, I started to help him with the total amount round $45000 after IRS froze his account. There is no written agreement or contract, however, I have all of his emails and text massage shows he will pay me back & the copy of casher's check, receipts from Money grand etc.

I gave him the notice to payback the full amount after I found out his cheating in Jan. He said he will pay back by Feb. 17th. But now nothing!

His email claims he will pay me the full amount plus $15000 additional. For the penalty, interest, and my business I loss(I couldn't order new stuff for my store in Christmas) etc.

Question:
Can I sue him for $45000 plus the amount he claimed to pay me back in his emails?
Do I need lawyer to sue someone with this amount even I have the proof?

Thank you very much for your help!

I can hardly imagine a businesswoman who would loan any amount of money without a written note. The amount is greater than small claims courts will allow so you have to go to civil court. For this I would recommend an attorney.

The e-mails should be sufficient proof for court. But even if you win (a likely event), you will still need to collect. And if the IRS has frozen his accounts, this may be difficult.
