Hi,

My friend was in the US on F1 visa in 2006(She first entered the US on F1 in 2002 or 2003).
Since it is still wihtin 5 years, I believe she still needs to file as a non-resident.

Her question is,
If her only income was from on-campus earning and was less than $3300 in 2006 but there is federal and state withholding, does she need to file 1040NR(EZ)? Because based on the earning(<$3300), it seems she doesn't need to but then how can she get her withholding back?

Your friend has no legal obligation to file because of her income level.

However, to get the withheld taxes back, she must file a tax return, and, for her, that return must be a Form 1040NR or 1040NR-EZ.
