I'm an resident alien married with one kid.

My wife and my kid have tourist visa but have been living with me for 9 months.

Can I obtain an ITIN number for my tax declaration even if they have a tourist visa?

You can file joint return as residents and claim your child. Prepare your tax return and attach W-7 (ITIN applications) and mail the tax return.

You need to make a clear photocopy of the passports picture pages for the wife and child, and have that photocopy NOTARIZED. This can be done at most local banks.

Then STAPLE the photocopy to the respective Form W-7, and paper clip BOTH W-7s to the tax return.

Mail everything to the IRS ITIN Processing Center in Austin, Texas. You can find the full address in the Form W-7 instructions.
