View Full Version : If I have no lease and paid all rent until this month what happens if I move out this

I have no leas I have paid all rent up to now and have yet to receive security deposit on last property from same landlord if I move out and just drop the keys off at his office wihtout paying for this months rent (the only month I ve not paid in two years only because I'm moving this month)will I be OK to do this or should I swallow it and pay for this months rent? I'm planning on not as long as there's no legal ramifications

You are obligated to give a 30 day notice and can be held liable to pay that notice.

You cannot choose how the deposit is used. The purpose of a deposit is to protect the landlord from damage left by the tenant. So you can't tell them to use the deposit for the last month's rent. If you do not give proper notice then can hold you liable for the rent until the end of the notice period. So if you move during February without notice, he can hold you responsible for the rental until march, possibly the end of March depending on local laws.

Legally you can't use a security deposit as rent.
But when did you last move, did you break a lease last time, was there any damage or reason to hold the deposit, and so on?
I guess what I'm wondering is this a good landlord or one who deliberately holds deposits? We are not there to hear his side of the story. And what communications have you had with him?

Also, did you pay an additional deposit on the current unit? Could it be the landlord just transferred the deposit from the previous unit?
